16 CFR Part 1250Safety Standard Mandating ASTM F963 for Toys
Core Objective
Reduce the risk of suffocation, chemical, and physical harm to children under the age of 14 from the use of toys.
What constitutes an “applicable toy”?
According to the definitions in 16 CFR Part 1250 and ASTM F963-17, an applicable toy is defined as:
Structural features: designed specifically for children under the age of 14, with no small hazardous parts or sharp edges.
Functional purpose: intended for children’s entertainment and cognitive development.
Testing and Certification Requirements
Third-party testing:
Toys must be tested by a third-party laboratory accredited by the CPSC to ensure compliance with 16 CFR Part 1250/ASTM F963-23 standards and all other applicable regulations governing the safety of children’s products.
Child Product Certificate (CPC):
Domestic manufacturers or importers must issue a Child Product Certificate (CPC) based on the results of third-party testing, with the following clearly stated in Part 2 of the certificate (Reference Standards): “16 CFR Part 1250 – Toy safety standard (incorporating ASTM F963).”
