16 CFR Part 1615——Standard for the Flammability of Children's Sleepwear:Sizes 0 through 6X(FF3-71)
Key objective:
To mandate that children’s pajamas automatically extinguish themselves after being removed from a flame source,rather than continuing to burn.
Scope of application and key definitions:
Target Audience: Suitable for children’s pajamas with sizes larger than 9 months up to size 6X.
What are children’s pajamas?
The CPSC’s definition of children’s pajamas is quite broad, encompassing not just products labeled as “pajamas.” It refers to any garment primarily intended for use during sleep or related activities (such as pre-sleep preparations, storytelling, and leisure activities at home), such as robes, nightgowns, housecoats, and the like.
Determining Factors: The CPSC considers the following factors when determining whether a garment qualifies as a children’s sleepwear item:
The structure and design of clothing.
Is it suitable for sleep or activities related to sleep?
The methods used to sell, promote, and commercialize a product.
Fabric characteristics (fiber composition, weight per square meter, printed patterns, softness, etc.).
Labeling and record-keeping requirements:
Unit Identification:Each pajama must have a permanent label indicating its corresponding FPU or GPU number,so that it can be traced during recalls.
Care label:It must include cautionary instructions on how to wash the product to preserve its flame-retardant properties(e.g.,refrain from using soap,as certain types of soap can leave residues that affect the flame-retardant properties).
Tracking Labels:As a product for children,it must also comply with the tracking label requirements of the CPSIA.
Record Retention:Manufacturers and importers must retain all test records for a minimum of 7 years.
